Pay reality

• 🔴 Can the kitchen share in the tips? Under federal law that depends on one thing — whether the restaurant takes a "tip credit." If it does (paying tipped staff a reduced cash wage, as low as $2.13/hr federally, and counting tips toward the $7.25 minimum), then a mandatory tip pool must be limited to staff who customarily receive tips themselves — servers, bussers, bartenders — and cooks and dishwashers cannot be included. If instead the restaurant pays the full minimum wage and takes no tip credit, federal law expressly allows a mandatory pool that DOES include dishwashers, cooks, and other back-of-house staff. In either case, the employer, managers, and supervisors may not keep or draw from the tip pool. State law can differ: Alaska, California, Minnesota, Montana, Nevada, Oregon and Washington require the full state minimum wage before tips (no tip credit), and Washington's own labor agency publishes an example confirming kitchen staff may be in the pool there. • 🔴 Being paid in cash — the honest version in one line: receiving cash is legal; not reporting it is illegal. Cash you report on your tax return is lawful income like any other. What cash pay usually costs you is the paper trail: without a W-2 or pay stubs you typically build no Social Security credit, have no unemployment claim, often have no workers' compensation coverage if you are hurt on the job, and hold no income record — and that missing record is exactly what a bank asks for when you apply for credit or a lease, and what immigration paperwork asks for when you have to document work or support. • 🔴 If the job comes with housing or meals ("room and board"), know how the law treats it. Federal law lets an employer count the REASONABLE COST of board or lodging toward your wages — reasonable cost means the employer's actual cost, not market rent, and it may not include profit. Two conditions matter most: the employer must customarily furnish it, and 🔴 your acceptance must be voluntary and uncoerced — housing you are required to take is not something that can simply be deducted from your pay. Some states cap the deduction separately. So room and board is not automatically illegal, and it is also not a reason your pay can fall below the minimum wage: ask what dollar amount is being charged against your wages, and get it in writing before you start. • 🔴 If you found this job through a placement agency, agency fees are regulated — and the rules are state law, not folklore. New York, for example, licenses employment agencies and sets fee limits in statute that vary by job class and wage level, and it limits how the fee may be collected in installments from a weekly-paid worker; an unlicensed agency's fee contract can be unenforceable. Other states have their own schemes, and some have none. So: ask for the fee in writing before you accept a placement, ask whether the agency is licensed in your state, and check your state's rules rather than the number posted on the wall.
